The ESB Employment Standards Branch (ESB) is responsible for ensuring that all employees under provincial jurisdiction, including temporary foreign workers (TFWs), receive minimum standards of employment and are treated fairly at work. In discharging its mandate, the ESB conducts investigations, inspections, and audits; issues decisions, permits, licenses and variances; collects unpaid wages and maintains mandatory employer registries. The ESB also engages in outreach and education to increase awareness of the rights and obligations of employees, TFWs and employers in BC.

The responsibilities of the Decision-Maker/Team Lead role consist of a balance of leadership activities and administrative decision making. The position supports a team of investigators who investigate and resolve complaints under the Employment Standards Act (the “ESA”) and the Temporary Foreign Worker Protection Act (the “TFWPA”). The Decision-Maker/Team Lead is responsible for overseeing these investigations, reviewing investigation reports, and writing decisions on investigations which do not voluntarily resolve. As a result, a sizeable portion of the position’s time is devoted to developing and working with their team of investigators and the Decision-Maker/Team Lead plays a critical role in ensuring the Branch’s work is of the highest quality. The role is also responsible for writing determinations under the ESA and TFWPA. Decision-Makers/Team Leads must efficiently organize their time and create space to write determinations.

Job Requirements:
In order to be considered for this position, your application must clearly demonstrate how you meet the education and experience as outlined below:

  • University degree and two (2) years of related experience* in administrative law and advanced investigative techniques; OR a combination of education and related experience will be considered.
  • Related experience* must include:
    • Two (2) years of experience providing legal analysis and/or adjudication/mediation and reasoning clearly and accurately in written format.
    • Two (2) years of experience interpreting and applying legislation, regulations and common law to varied and often complex situations to properly and defensibly exercise delegated decision-making authority.
  • One (1) year of people leadership (e.g. coaching, collegial mentorship, membership on a board of directors, etc.), supervision (direct/indirect) or management
  • Experience formulating and articulating advice and recommendations and making presentations to a variety of audiences, including employees, employers, stakeholders, the public, investigators, and senior decision makers; and
  • Experience dealing proactively and effectively with others using tact, discretion, and sound judgement.

Preference may be given to applicants with:

  • Experience supporting your team in professional goal development and performance management
  • Experience educating the public or facilitating internal staff learning and development
  • Experience with case management software ICM, Salesforce, DRS, CTS, CRMS, etc.
